How Does a 1031 Exchange Usually Work?
In a simple, forward exchange, the taxpayer sells relinquished property and the proceeds from such sale are held by a qualified intermediary. The taxpayer must then identify and close on suitable replacement property within 180 days of the closing date of the initial relinquished property transaction. When closing on replacement property, the qualified intermediary provides the exchange funds directly to the closing agent and title to the replacement property is conveyed directly to the taxpayer.
While a forward exchange is the most common, other forms of 1031 exchanges exist, such as reverse exchanges (where the replacement property is purchased before the relinquished property is sold) and improvement exchanges (where the taxpayer purchases replacement property and performs improvements to the property using exchange funds during the exchange period).
